Your rights in pocketsize

Remember

If you give your name, adress and date of birth, the longest time the police can keep you is:
* For interrogation or identification - 6 hours (12 hours in special cases).
* PL (read out PoliceLaw) § 13 - 6 hours (even if you still are unidentified).
* Arrest - 24 hours, then they have to apply for a warrant of detention (can be prolonged up to 96 hours at the most).
* Do not sign any papers no matter what they promise or make threats about.
* It is not permitted for men to do, participate in or to be present at visitation/personal search on women.
* You can request for a translation of Law 1976:371 (about treatment of people in arrest or custody).
* Under interrogation just give name, date of birth and adress. Answer "no comment" to any other questions.
* Have in mind that comrades working in prisoner solidarity groups will try to contact you, so keep your spirits up!
* Arrange with somebody ahead of the demonstration/action that if you should get arrested or not heard from within a determined time limit, he or she must contact a prisoner solidarity group and your embassy.
* If questioned, you have to be able to identify yourself, so always bring your passport.

Important for foreign citizens

Foreign citizens who are suspected of any crime, which can lead to imprisonment will probably be held in custody for a longer time than Swedes will be. That's because the authorities believe that there is a considerably risk that the suspect will leave the country. Every other week the case of the person kept in custody must be notified by a prosecutor, who is to bring forward a request to the city court, which have to decide if there will be an extend.

General Advice - When participating in demonstrations or actions, it sometimes can be necessary to hide your face, in order to make identification more difficult. Be aware of that, although not illegal, masking can result in you beeing taken in to custody, according to PL (PoliceLaw) § 13. It's good to bring money, ID/passport, watch and a telephone card if you get arrested, but leave adressbooks, and other things that can lead further on to comrades, at home.

Arrest, Visitation/Personal search

If the police bust you for identification only, they have to let you go within 6 hours (12 in special cases). If you show ID, they are not allowed to arrest you.

Sometimes the police use PL § 13 in order to arrest or drive away activists, participants or spectators during demonstrations, etc. They don't have authorisation to hold you more than 6 hours, even if they haven't succeeded in identifying you.

If you get beaten up by the police, you should see a doctor, in order to get your injuries confirmed as evidence. It would be wise to file a report for statistics or to get economic compensation.

Taken in for questioning

When arrested or taken in for questioning, you can at the most be held for 6 hours. Except for:
- if you are kept under custody.
- if you are suspected of crime (then you can be held up to 12 hours).
- if you are 14 or younger (then you can be held 3 resp. 6 hours).

When they have interrogated you enough or the time expired, you have the right to leave immediately, and they are not allowed to interrogate you without "particular reasons", within 12 hours.

The interrogator is not allowed to lie, threaten, bribe, force or exhaust you. You got right to "meals as -
